Emergency waiver issued for E10 & E15

Effective May 1, the EPA has issued an emergency waiver for both E10 & E15 that temporarily lifts federal restrictions on the sale of E15/UNL88 with 9.0-pound RVP base gasoline. The EPA has also waived provisions that would have otherwise made E10 gasoline sold in Illinois, Iowa, Minnesota, Missouri, Nebraska, South Dakota, and Wisconsin meet a more stringent standard than conventional gasoline in other parts of the country.

This emergency waiver will last for a period of 20 days. While we anticipate that the EPA will continue to issue waivers throughout the summer to allow retail sales of E10 and E15 with 9.0-pound RVP base gasoline from June 1 to Sept. 15, 2026, where applicable, you should confirm that a waiver is effective during any summer period you are selling E15.

The EPA is required to re-evaluate and reissue this waiver every twenty days due to its emergency status. Provided the EPA issues appropriate waivers, as noted above, E10 and E15 may be blended, dispensed, and sold with 9.0-pound RVP base gasoline during the upcoming summer timeframe where applicable, and E15 availability will continue through our CHS wholesale terminals for customers to purchase.

While the waiver’s official announcement is not a permanent legislative change to allow for year-round sales of E15 for the long-term, it does provide retailers the opportunity to continue to sell E15 during periods covered by waivers in summer 2026 if they choose to do so. As America’s largest farmer-owned cooperative, CHS will continue to fully support efforts to broaden availability of ethanol blended fuels to consumers, including the year-round sale of E15.

It is vitally important that if any of your sites are offering E15 that the site is accurately registered using our E15 registration portal at CenexE15.com. In addition, all sites, at all times, must adhere to all Cenex brand standards as required in the Branded Petroleum Marketer’s Agreement (BPMA).
